1. Purpose
This Acceptable Use Policy outlines your obligations as a licensed insurance agent using the Writesure platform. By using the Service, you agree to comply with these requirements. This policy is designed to protect consumers, maintain lead quality, and ensure a trustworthy marketplace for all participants.
2. Agent Obligations
2.1 License and Compliance
- You must maintain a valid, active insurance license in every state for which you receive leads.
- You must promptly notify us at hello@writesure.co if your license is suspended, revoked, or if you change your licensed states.
- You are solely responsible for ensuring your compliance with all applicable federal, state, and local laws and regulations.
2.2 Lead Contact Standards
- Timely contact: Contact each lead within a reasonable timeframe. We recommend making your first contact attempt within 5 minutes for maximum effectiveness, but no later than 24 hours after delivery.
- Professional conduct: All communications with consumers must be professional, truthful, and compliant with applicable regulations.
- Purpose limitation: Use lead data exclusively for the purpose of offering insurance products. Do not use lead data for any other commercial or personal purpose.
2.3 Data Protection
- No resale or redistribution: You may not sell, share, transfer, or make available any lead data to any third party, including other agents, agencies, data brokers, or lead aggregators.
- Secure storage: Store lead data securely and take reasonable measures to prevent unauthorized access.
- Data minimization: Retain lead data only as long as necessary for your business purposes and in compliance with applicable data retention laws.
- Breach notification: Notify us promptly at hello@writesure.co if you experience a data breach affecting lead information received through Writesure.
3. TCPA and DNC Compliance
The Telephone Consumer Protection Act (TCPA) and Do Not Call (DNC) regulations impose specific requirements on how you contact consumers. As an agent using Writesure leads:
- Each lead is delivered with TCPA consent documentation. You are responsible for reviewing this consent before contacting the consumer.
- You must honor consumer requests to stop contact. If a consumer asks not to be called, add them to your internal do-not-call list immediately.
- You are responsible for scrubbing your call lists against the National Do Not Call Registry as required by law.
- You must comply with state-specific telemarketing rules, including time-of-day restrictions and registration requirements.
- Writesure provides the consent record and TrustedForm certificate for each lead. You are solely responsible for your outreach practices and any claims arising from your contact methods.
4. Prohibited Activities
The following activities are strictly prohibited on the Writesure platform:
- Data resale: Selling, sharing, or redistributing lead data in any form.
- Misrepresentation: Misrepresenting your identity, credentials, license status, or affiliation.
- Spam or harassment: Excessive or harassing contact with consumers.
- Fraudulent feedback: Submitting false lead quality reports or feedback to obtain credits.
- System abuse: Attempting to manipulate the auction system, create multiple accounts, or exploit platform mechanics.
- Unauthorized access: Attempting to access other agents' data, accounts, or lead information.
- Illegal activity: Using the Service or lead data in connection with any unlawful activity.
5. Feedback Obligations
Agent feedback is a core component of Writesure's quality model. By using the Service, you agree to:
- Provide honest feedback on leads when requested (e.g., contacted, sold, bad number, not interested).
- Report invalid leads promptly and accurately per the Lead Quality Policy.
- Not submit fabricated or misleading feedback.
Feedback is used to improve lead quality for all agents. Providing accurate feedback helps us maintain high standards and benefits the entire platform.
6. Consequences of Violation
Violations of this policy may result in:
- Warning: For minor or first-time violations, we may issue a written warning.
- Temporary suspension: Your account may be suspended pending investigation.
- Permanent termination: Severe or repeated violations may result in permanent account closure.
- Forfeiture of balance: Accounts terminated for policy violations forfeit any remaining balance or credits.
- Legal action: We reserve the right to pursue legal remedies for violations that cause harm, including data breaches or fraud.
We will notify you of any enforcement action and provide an opportunity to respond before a final determination is made, except in cases of clear fraud or imminent harm.
7. Reporting Concerns
If you become aware of any agent or third party violating this policy, please report it to us at hello@writesure.co. Reports are handled confidentially.
8. Changes to This Policy
We may update this policy from time to time. Changes will be posted on our website and communicated to active accounts. Continued use of the Service after changes are posted constitutes acceptance.
